We have two authentic hadiths, one that says The Prophet ﷺ was cupped while fasting and during ihram and another hadith where The Prophet ﷺthat says that someone who cups and the one who is cupped has broken their fast.

This apparent contradiciton is reconciled by Imam Ash-Shafi’.

 


 

 

Translation: Imam Ash-Shafii said in Ikhtilaf al-Hadith after bringing the hadith of Shaddad with the wording: “We were with the Messenger of Allah during the year of conquest, and he saw a man getting cupped on the eighteenth of Ramadan. He said, while holding my hand: The one who cups and the one who is cupped have broken their fast.” Then he mentioned the hadith of Ibn Abbas that the Prophet got cupped while fasting.

He said, “The hadith of Ibn Abbas has the strongest chain. But if someone avoids cupping, that is preferable out of caution. And analogy supports the hadith of Ibn Abbas. What I remember from the Companions, the Followers, and the majority of the people of knowledge is that no one breaks the fast by cupping.” I say: That seems to be the reason why al-Bukhari placed the hadith of Ibn Abbas (1938) after the hadith, “The one who cups and the one who is cupped have broken their fast.”

Ibn Abd al-Barr and others said that this hadith is a proof that the hadith, “The one who cups and the one who is cupped have broken their fast,” is abrogated, because in some of its routes it is mentioned that it occurred during the Farewell Pilgrimage. Ash-Shafii also held that view.
